Booking Terms and Conditions

Fair Trading Agreement: Please read this page carefully. When you book your Waterway Holiday with us you are in fact signing a contract which binds you and us in various ways.

  • 1. TERMS
    All terms are quoted in £ sterling and are per period as set out on the booking form, or are as otherwise defined by Galleon Marine.
  • 2. BOOKING CONFIRMATION
    The submission of the completed booking form (or telephone agreement) shall constitute an offer by the Client and a Contract shall come into existence if and when Galleon Marine confirm the booking in writing.
  • 3. BOOKING DEPOSIT
    When you book, the Initial Payment stated must be sent. The deposit will be 25% of the total cost, which includes the Cancellation Scheme subscription.
  • 4. BALANCE OUTSTANDING
    You are responsible for the whole of the hire Terms. The balance of hire monies are due and payable by you 6 weeks before the hire starting date. Galleon Marine reserves the right to re-let the boat if payment is not received by the due date, and to pass on any bank charges or other costs incurred in the representing of cheques etc.
  • 5. CANCELLATION SCHEME
    Our cancellation scheme is included in the hire fees and is calculated at 3% of the total hire costs.
    Neither the subscription nor the booking deposit are refundable. Should you have to cancel your holiday through sickness, injury, death, jury service or witness call of a member of your party, then on receipt of the appropriate independent documentation you will be exempt from paying the balance outstanding. If you are compelled to cancel your holiday you must notify us immediately by telephone. Follow this in writing by first class mail to reach Galleon Marine no later than the day prior to the start of your hire. It is deemed warranted that at the time of booking each and every member of the party is in good health and is not suffering from any undisclosed chronic or recurring illness.
  • 6. BOOKING RESTRICTIONS
    Bookings from persons under 21, from all male or all female parties or from mixed non-family groups under 35 years, cannot be accepted without the prior written consent of Galleon Marine. Should such a booking take place without this prior written consent, then Galleon Marine reserve the right to cancel the booking and to withhold all monies paid pending re-letting. When re-let booking monies will be returned less 25% of the total to cover administrative costs. Should it not prove possible to re-let then the total hire costs are forfeited and payable to Galleon Marine.
  • 7. UNSUITABLE HIRERS
    Galleon Marine reserves the right to decline to accept a booking or to refuse to hand over a boat to any person who in their opinion is not suitable to take charge on the grounds of age, ill health, disability, inexperience or any other reason. In such cases, the hire terms paid shall be refunded in full and the contract shall be discharged without further liability on either party. Galleon Marine reserves the right to repossess the boat at any time where a serious accident or damage has occurred or in the opinion of Galleon Marine is likely to occur because of the unsuitability of the hirer due to age, ill health, disability, inexperience or any other reason. In such cases, Galleon Marine shall not be liable to make a refund of any portion of the hire terms paid.
  • 8. AVAILABILITY
    The booking is made on the understanding that the boat will be placed at your disposal on the date stated. In the unlikely event that this should not be possible through force majeure or other circumstances not under the control of Galleon Marine (e.g. damage, mechanical breakdown, late return by previous crew etc.) we cannot guarantee to provide an alternative boat. We will make every effort to provide another boat and if this is not possible we will return any payment you made prior to this. In such cases all hire charges paid shall be refunded in full and the contract shall be discharged.
  • 9. ACCOMMODATION
    The number of persons indicated for each boat must not be exceeded except where provision for extra persons exists and where specific permission has been given by Galleon Marine. Comfort is likely to be impaired by any increase in numbers and an additional accommodation charge will be made. The names of all members of your party must be entered on the booking form. Any changes required must be notified to and agreed by Galleon Marine prior to the Change taking effect.
  • 10. LAYOUT PLANS
    All layout plans are for general guidance only. They are not to scale and alterations to accommodation etc., may occur to any of the boats during building or re-fitting.
  • 11. BOAT TRIAL A free demonstration run is given to you at the time of take-over before you start your Waterway Holiday. Whenever possible the person responsible for the booking must be present. After this you are held responsible for any damage or loss to your boat and its equipment.
  • 12. BOAT DELAYS OR CURTAILMENTS
    No responsibility will be accepted for loss of time or expenses occasioned through accidental damage to the boat while in your charge. No liability can be accepted for loss or damage or expense which occurs as the result of any defect or breakdown occurring during your cruise unless this is caused by reason of Galleon Marine's failure to adequately maintain the boat in a fit state and condition. Any defect or breakdown must be reported immediately to Galleon Marine during your cruise so that steps can be taken to repair the boat or remedy the service. (it is unlikely that trouble of this nature will arise as every boat is carefully checked before the start of each cruise.) It is the hirer's responsibility to liaise with the relevant authorities for any specific cruising requirements. Galleon Marine shall not be responsible for the consequences or delays or restrictions arising from obstructions. repairs or damage to navigational works, flooding, shortage of water, industrial action, fuel-rationing, shortage of or non-availability of fuel, or any other cause, and reserve the right to restrict cruising if unusual or hazardous conditions prevail.
  • 13. SECURITY DEPOSIT/DAMAGE WAIVER
    You must pay a security deposit as defined by Galleon Marine, which will be returned to you by post following completion of the hire period provided you return the boat and its equipment on time, undamaged, clean and tidy and without third party claim against you OR: Make a one-off non-refundable payment to cover you in the event of any accidental loss or damages. If additional cleaning of your boat is required after your holiday. an extra charge will be made.
  • 14. EXCLUSIONS
    Damage caused by any of the following is excluded from the Security Deposit and Damage Waiver Schemes.
    A. Speeding
    B. Malicious or intentional action or wilful neglect.
    C. Damage caused in locks or at bridges by lack of due care and attention.
    In all these cases the hirer agrees to indemnify Galleon Marine with the full cost of the necessary recovery, repairs and or replacements together with any resultant loss of income which may occur due to the boat being out of commission.
  • 15. SHORTCOMINGS
    You are asked to notify any shortcomings on your boat to Galleon Marine immediately so that they can be remedied for you. No claim can be considered for shortcomings not so notified.
  • 16. OBEYING THE WATERWAY RULES
    You must observe the Navigation Authorities bye- laws, including, particularly, the rule that you must not navigate after sunset, or before dawn and YOUR SPEED MUST NOT EXCEED 4MPH - 2MPH IS RECOMMENDED.
  • 17. RESTRICTIONS
    Under no circumstance may firearms or live fishing bait be taken on the boat. You may not tow nor normally be towed by other craft. NO BICYCLES, HEATERS, T.V. SETS OR ELECTRICAL APPLIANCES MAY BE TAKEN ON BOARD YOUR BOAT.
  • 18. ACCIDENTS
    Whilst your boat is insured you have charge of the boat and are responsible for its safe navigation. No minor may control your boat without the supervision of an experienced adult. In the case of any accident or damage to the boat, or other craft, or to waterway property it is your responsibility to:
    1.
    Find out the name of the other boat involved together with the name of the owners and hirer.
    2. To report these facts, together with the extent of the damage to Galleon Marine as soon as possible. Do not wait until the end of your hire.
  • 19. LOSS OF WATER You are responsible for any charges made by Waterways Authorities in respect of the loss of water or damage to waterway properly caused by you.
  • 20. PETS
    You are normally allowed to bring your cats or dogs with you, for an additional charge per pet. You must tell us that you are bringing your pet when you make your booking. An additional security deposit is also required as a safeguard against damage or for any extra cleaning which may be required. You will need to bring your pet blanket or pet basket as pets are only allowed on the clear understanding that UNDER NO CIRCUMSTANCES ARE YOUR PETS ALLOWED ON THE BEDDING ON SEATS, NOR MAY THEY BE LEFT UNACCOMPANIED ON THE BOAT AT ANY TIME.Your pet is not covered under our insurance. As you are totally responsible for all damages and losses caused by your pet to either the boat and its equipment or to any third party, you are recommended to ensure that you have adequate insurance cover for your pet. If extra cleaning of your boat is required after your holiday because of your pet. an extra charge will be made.
  • 21. MOTOR VEHICLES
    Your vehicle and their accessories and contents are left at your risk. Galleon Marine will not be responsible for loss or damage thereon or thereto from any cause whatsoever.
  • 22. SERIOUS ACCIDENTS
    Galleon Marine will not be responsible for any death or personal injury save in-so-far as it results from their proven negligence. You are recommended to take out Personal Holiday Insurance for your Waterway Holiday.
  • 23. RETURN OF BOAT IT IS SOLELY THE HIRER'S RESPONSIBILITY TO RETURN THE BOAT
    (including all its gear and equipment) in a clean and tidy condition BY THE DESIGNATED DATE AND TIME to Galleon Marine at their boatyard. If the boat is not returned and vacated by the designated time the HIRER AGREES TO PAY TO Galleon Marine as liquidated damages the sum of £30 for every hour or part hour thereafter that the boat is over-due or occupied. THIS IS STRICTLY ENFORCED IN ORDER TO ALLOW US TIME TO PREPARE THE BOAT FOR THE NEXT HIRER. Should Galleon Marine have to effect recovery of the boat then the Hirer will also be responsible for the full costs of any such recovery.
